An example of a recent wrongful death case handled by our office:  The wrongful death lawyers in this law office recently secured a policy limits settlement on behalf of the family of a Kansas City man killed in an accident in Olathe, KS involving a commercial vehicle with a gross vehicle weight of over 80,000 pounds.  This fatality accident took place on I35 in Olathe, KS.  During the discovery process, we were able to demonstrate a number of defects present in the commercial vehicle that contributed to the cause and severity of the accident.

First, we were able to demonstrate that the commercial vehicle’s brakes were faulty in a number of different ways, including leaking air lines, poor brake balance, a defective compressor, and several other problems.  We argued that these defects contributed to the cause and the severity of the collision which resulted in the death of a Kansas City, Kansas man.  

We were also able show that the commercial vehicle had a faulty windscreen which may have limited it’s driver’s visibility to see other vehicles and react to events on I35 as he traveled through Gardner and Olathe during rush hour.

We further demonstrated that the driver of the commercial vehicle had not been properly trained, had very little experience on the type of vehicle he was driving, and did not have the proper license endorsements to drive the extremely heavy commercial vehicle.  Experience counts, and this driver did not appear to know how to properly control his vehicle in an emergency situation.  

Finally, we demonstrated that the company who owned the commercial vehicle had not obtained the proper permits to operate it on I35 during rush hour.
